1. Acceptance of Terms
By accessing and using MyACB ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is owned and operated by MyACB ("we," "us," or "our"), located in British Columbia, Canada.
2. No Professional Tax or Financial Advice
MyACB is a software tool for information and tracking purposes only.
- We are not financial advisors, tax accountants, or registered investment dealers.
- The calculations, reports (including Schedule 3 and T3 estimates), and data provided by the Service do not constitute professional tax advice.
- You acknowledge that you are solely responsible for the accuracy of your tax filings. You should verify all calculated values with a qualified tax professional before filing your return with the Canada Revenue Agency (CRA).
- We do not guarantee that the Service will meet the specific requirements of the CRA or that it is error-free.
3. Data Accuracy and Third-Party Data
The Service relies on data provided by you (via CSV import or manual entry) and third-party sources (e.g., Bank of Canada exchange rates).
- User Data: You are responsible for the accuracy of the transaction data you import or enter.
- Bank of Canada Exchange Rates: Exchange rates used by the Service are sourced from the Bank of Canada (bankofcanada.ca). Bank of Canada exchange rates are indicative rates only, obtained from averages of aggregated price quotes from financial institutions. They are intended to be broadly indicative of market prices at the time of publication but do not necessarily reflect the rates at which actual market transactions have been or could be conducted. They are released for statistical and analytical purposes only and are not intended to be used as the benchmark rate for executing foreign exchange trades. The use of Bank of Canada data does not imply endorsement by the Bank of Canada of the Service or MyACB.
4. Account Security
- You are responsible for maintaining the confidentiality of your login credentials (email links/passwords).
- You are responsible for all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account.
5. Intellectual Property
- Our IP: The Service, including its code, branding, and algorithms, is the intellectual property of MyACB.
- Your Data: You retain full ownership of the financial data and transaction history you upload to the Service. By using the Service, you grant us a limited license to process this data solely for the purpose of providing the Service to you.
6. Billing, Payment, and Refund Policy
If you subscribe to a paid plan:
- Fees: Subscription fees are clearly displayed on our website and are subject to change with notice.
- Payment Processing: All payments are processed securely through Stripe, a third-party payment processor. We do not store or have access to your full credit card information. By submitting payment information, you agree to be bound by Stripe's terms and privacy policies.
- Billing Cycle: Subscriptions are billed in advance on a recurring basis (monthly or yearly, depending on your selected plan).
- 7-Day Money-Back Guarantee: If you are not satisfied with the Service, you may request a full refund within 7 days of your initial purchase by contacting us at [email protected]. After this 7-day period, all payments are final and non-refundable except as required by applicable law.
- Cancellation: You may cancel your subscription at any time. Cancellation will prevent future charges but does not refund any previously paid fees. You will retain access to the Service until the end of your current billing period. Within 7 days of your initial purchase, you may request a refund.
- Failed Payments: If a payment fails, we may suspend or terminate your access to the Service until the outstanding balance is resolved.
7. Limitation of Liability
To the fullest extent permitted by applicable law in British Columbia:
- In no event will MyACB be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, tax penalties, interest levied by the CRA, or data loss.
- Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you, if any, for using the Service during the twelve (12) months prior to the claim.
8. Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia.
10. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after such updates constitutes your acceptance of the new Terms.
11. Acceptable Use
You agree to use the Service only for its intended purpose of tracking your personal investment transactions and adjusted cost base. You may not:
- Scrape, crawl, or use automated means to extract data from the Service.
- Resell, sublicense, or redistribute access to the Service or any data generated by it.
- Attempt to reverse-engineer, decompile, or derive the source code of the Service.
- Interfere with or disrupt the Service, its servers, or the accounts of other users.
- Use the Service for any unlawful purpose or in violation of any applicable Canadian federal or provincial law.
- Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
- Share your account credentials with others or allow third parties to access the Service through your account.
We reserve the right to suspend or terminate access to any account that we reasonably believe is in violation of this section.
